I’m on SSD. In that position than the children would receive children’s benefits from SSD that would not affect the amount you receive. Many states consider this child support and discontinue your payments.
Others do a calculation of what you pay, than deduct the amount. Some consider the money gifts you still have to pay child support based on what you are receiving in disability.
I have a man in Kansas that Nebraska is trying to get $65,000 in arrears from. He has been disabled for ten years with a neuro muscular disease. Kansas is refusing to enforce the order, but Nebraska attaches his income tax and filed to have his driver’s license suspend, using the federal law.
If you were to be receiving long term disability from an insurance policy, that the normal rules would apply for setting child support based on your income.
